Property in Self Managed Superannuation
Any SMSF can buy an established investment property if the fund has the cash available to purchase it.
Investment property can be Residential, Commercial or Business Real Property.
Since 2008, it has also been possible to purchase property in SMSF using finance. This involves a particular legal arrangement utilizing a Property Holding Trust (aka Bare Trust). We have been involved in a significant number of these arrangements.
However, a SMSF cannot build or develop property as this would constitute being in business and is against the Sole Purpose Test Rules of the SMSF.
